#Gabon: La conférence nationale souveraine doit se tenir!


Chers compatriotes,

La Conférence Nationale Souveraine était prévue pour  septembre 2012. Un délai supplémentaire a été laissé à Ali Bongo et les siens pour s’y associer. Il ne l’a pas fait parce qu’il a peur.

Il a peur du grand déballage public, lui qui aime assez agir dans l’ombre et être couvert à toute occasion ;
Il a peur de la découverte du secret de ses origines, lui qui tient de sa filiation la légitimité de ce qu’il a et de ce qu’il est ;
Il a peur que la clarification de son élection frauduleuse soit incompatible avec son maintien au pouvoir;
Il a peur que le PDG lui échappe;
Il a peur d’être poursuivi ou emprisonné pour ses actes ;
Il a peur de n’être plus rien, lui qui ne sait presque rien faire de ses dix doigts ;
Il a peur des quolibets et lazzis, lui qui aime être adulé et craint ;
Il a peur de perdre des biens mal acquis et les moyens de sa prédation sur notre économie;
Il a peur d’être pauvre et de mendier sa pitance lui qui ne sait pas gérer son argent.

Nous n’avons que faire des peurs d’un usurpateur et d’un enfant gâté.

La Conférence Nationale Souveraine est une étape fondamentale pour la construction de notre société, son renouvellement et sa refondation;
C’est le meilleur moyen d’apaiser les Gabonais ;
C’est le meilleur espace de débat;
C’est le meilleur palliatif aux élections truquées ;
C’est la structure idéale pour des choix fondamentaux de notre organisation sociale et politique ;
C’est la garantie de l’application de toutes les résolutions adoptées ;
C’est la garantie contre la permanence au pouvoir d’un homme, d’un parti ou d’une famille.

En s’y opposant, Ali Bongo défend des intérêts particuliers, pas l’intérêt général. Il est un obstacle à la démocratie et à l’Etat de droit dans notre pays. Nous devons nous en débarrasser.

L’heure est à l’action méthodique, réfléchie, concertée et démocratique. La Conférence Nationale Souveraine doit se faire.

Les dictateurs et nous: le Gabon comme le dernier meilleur ami du Royaume-Uni

Après une rapide visite en Arabie saoudite, il semble désormais clair que le gouvernement britannique de David Cameron est déterminé à ne pas laisser une petite chose comme la dictature, la corruption ou les violations des droits humains de l’emporter face aux affaires. Maintenant, le Royaume-Uni fait la cour au président du Gabon, Ali Bongo Ondimba, tout droit vers le chemin qui mène au champ de pétrole...

Ali Bongo est le fils du dictateur de longue date du Gabon, Omar Bongo, décédé en 2009 après avoir gouverné ce pays producteur de pétrole pendant plus de quatre décennies. Bongo junior est arrivé au pouvoir lors des élections qui ont été largement qualifiées par les Gabonais comme truquées, bien que les observateurs internationaux n'étaient pas aussi critiques. L'opposition a rejeté les résultats officiels, et des émeutes ont éclaté dans la deuxième ville du Gabon, Port-Gentil.

Avec une population de 1,5 million d'habitants et de vastes richesses pétrolières, le Gabon est l'un des pays les plus riches d'Afrique. Toutefois, en commun avec d'autres États producteurs de pétrole en Afrique, près de 20 pour cent de la population détient 90 pour cent de la richesse.

Dans une indication claire de ses intentions, le Royaume-Uni est sur le point d'ouvrir un bureau pour un « attaché commercial » à Libreville au Gabon, la capitale. Haut Commissariat au Cameroun et ambassadeur non résident au Gabon, Bharat Josh, a récemment visité le pays en mission de « faits » pour préparer le chemin pour les liens commerciaux entre le Gabon et la Grande-Bretagne. Cela fait suite à plusieurs visites au Royaume-Uni quand Ali Bongo a rencontré le Premier ministre David Cameron et le ministre pour l'Afrique, Henry Bellingham, en mai.

Le président Bongo était un visiteur enthousiaste pour les Jeux olympiques au Royaume-Uni pendant l'été où il a rencontré Son Altesse Royale le prince de York et M. Bellingham. Il a également rencontré leurs Altesses Royales le duc de Cambridge et le prince Henry de Galles, et les a invités au Gabon. Cela a apparemment été accepté et programmé pour l'année prochaine.

Le Gabon va clairement à plat ventre faire la cour au Royaume-Uni et aux Etats-Unis, y compris par le passage de la langue nationale de l'anglais au français. Le Gabon a été un atout majeur pour la Françafrique depuis l'indépendance de la France en 1960. Omar, le père d’Ali Bongo, a été maintenu au pouvoir avec le soutien de la France et il a certainement payé son dû. Bongo père aurait rempli ses poches avec l'argent des 37 millions de dollars (28 millions d'euros) du système de détournement de fonds bancaires et canalisé une partie de cet argent au profit des partis politiques français et l’ancien président Nicolas Sarkozy, selon un télégramme classifié de l'ambassade américaine. La même source diplomatique affirme que des hauts dirigeants politiques du Gabon, y compris le président défunt Omar Bongo et son fils Ali Bongo ont bénéficié des détournements de fonds.

La famille Bongo gère le Gabon comme une tirelire. Dans un reportage pour ABC News, le sénateur Carl Levin a dit: « Omar Bongo et maintenant son fils Ali Bongo ont depuis plus de 40 ans fait fonctionner un régime au Gabon qui détourne la richesse de leur pays à des fins personnelles de leur famille. » ABC a rapporté que la famille possède des maisons aux États-Unis et 30 propriétés de luxe en France, « y compris une de 120 millions de dollars, soit un hôtel particulier de 14 chambres à Paris, qu'Ali Bongo a acheté l'année dernière ». [2011]

Un rapport du Département d'Etat américain affirme que, malgré « quelques améliorations », le Gabon est toujours un lieu de « corruption généralisée du gouvernement », marqué par « l'usage excessif de la force par la police », où même la prise en photo des nombreux palais des Bongo est contraire à la loi .

En haut de la liste pour la visite de l’ambassadeur du Royaume-Uni en Septembre a été Setanta Energy. Setanta est en lice pour développer le gisement pétrolier de Roussette Gabon dans une affaire partagée entre l'entreprise et une société angolaise conduite par Vincent Miclet, Français et l’Angolais, Dos Santos Sandro.

L'entreprise affirme qu'elle pourrait commencer à produire du pétrole, avec une valeur estimée à près de 4 milliards d'euros à prix courants, dont 25% reviendraient au Gabon, dans les 2 ans. Cependant, des sources diplomatiques ont indiqué que le partenaire proposé dans l'accord est «une société inconnue d’origines douteuses, 51% angolaise et 49% enregistré dans une fiducie opaque localisée dans les îles Vierges britanniques.« Ce «partenaire douteux», a été nommé Petroplus par Africa Intelligence bien que cela ne semble pas être la société basée en Suisse qui est entrée dans l'administration.

Quel que soit ce partenaire louche en attente d’être révélé, le Royaume-Uni se soucie nettement plus des affaires que de la soi-disante politique étrangère éthique réclamée auparavant. Amnesty International suggère que le Gabon est un Etat policier contrôlé par le parti de Bongo, le Parti démocratique gabonais (PDG). Bongo a le droit d'opposer son veto à la législation déjà adoptée et dissoudre l'Assemblée nationale, demander une nouvelle élection, ou de gouverner par décret présidentiel. La Cour Constitutionnelle est présidée par nul autre que la mère d'Ali Bongo, qui est décrit par les militants comme l'un des principaux blocages à la démocratie. Avec une garde républicaine qui le protège et une armée formée à partir de son propre groupe ethnique et allié, les Batéké, Bongo peut cocher toutes les cases qui décrivent une dictature entièrement bien payée.

Selon une lettre passionnée écrite par un groupe de militants de la société civile à l'occasion d'une visite d'Ali Bongo aux États-Unis et reçu par Barack Obama: « Les journalistes sont emprisonnés et menacés de mort, simplement parce qu'ils dénoncent la corruption et les actions anti-démocratiques et accusent les gens du gouvernement ou de la famille du président. »

Les États-Unis sont également sur la liste des meilleurs amis du Gabon; le Gabon ayant droit aux avantages commerciaux préférentiels en vertu de l'African Growth and Opportunity Act. Selon le Département d'Etat américain, les investissements américains au Gabon sont concentrés dans les secteurs pétroliers et miniers. Le Département d'Etat, en ignorant un rapport sur la corruption produit par son propre personnel, poursuit en disant: « Les États-Unis ont salué les réformes que le Gabon a entreprises pour apporter plus de transparence et de reddition de comptes au gouvernement ».

Avec plus d’affront que Walmart, Ali Bongo accuse les « problèmes historiques de l'administration précédente et la fraude par « certaines compagnies pétrolières internationales » pour bloquer les plans d'investissement du Royaume-Uni. Même si un document divulgué, prétendument lors de la visite diplomatique du Royaume-Uni, suggère que le Royaume-Uni est désireux d’obtenir des contrats, en disant au gouvernement du Gabon: « Qu'il était important de continuer et de rechercher les livrables le plus tôt possible ».

Citant « la couverture négative internationale à la suite des arrestations de sympathisants de l'opposition et de la fermeture de deux journaux d'opposition après le retour d'André Mba Obame (ancien chef de l'Union nationale, le parti interdit en 2011) », les visiteurs du Royaume-Uni ont suggéré que le Gabon a besoin de changer son image. Les commentaires du diplomate: « J'ai été frappé que les gens d’Obame sortaient leur histoire de façon agressive, y compris par l'utilisation des médias numériques: le gouvernement a besoin de sortir aussi sa version des faits. » Cela semble être l'essence de la politique étrangère britannique en Afrique en 2012.

Gabon-Pétrole: Setanta Energy et PetroPlus se partagent Roussette : le peuple gabonais a-t-il l’heure juste?



Devant les Nations Unies, Ali Bongo est allé plaider pour une Justice impartiale. On peut bien se demander à quoi rime ces messages hypocrites d'un président mal élu en quête de légitimité. En effet, pendant que Ali Bongo se pavane à l'international, seul endroit où quelqu'un écoute encore ce qu'il dit, pour raison évidente d'intérêt de venir piller nos ressources, nous apprenons que des transactions douteuses continuent d'être légion dans l'émirat pétrolier gabonais.

Une dépêche récente de «Africa Energy Intelligence» nous apprend que le champ pétrolier de Roussette que convoitait depuis quelques temps la compagnie britannique (basée à Port-Gentil), Setanta Energy, sera partagé entre cette compagnie et la compagnie angolaise PetroPlus dirigée par le Français Vincent Miclet et l’Angolais Sandro Dos Santos. Mais dans quelles conditions cette transaction s'est elle passée?

C'est là que devient intéressant de parler des informations que nous avons et qui nous apprennent que le cas Setanta Engery a été discuté entre Ali Bongo et les autorités britanniques à plusieurs reprises ces derniers temps, incluant lors de sa rencontre avec le Premier ministre britannique en  Mai dernier. Nous savons que Ali Bongo aime bien le Royaume Uni; ses enfants y étudient. Une rencontre au sommet devrait avoir lieu en Novembre prochain entre autres, afin de redynamiser les relations diplomatiques entre le Royaume-Uni et le Gabon. Le Gabon a demandé au R-U de ré-ouvrir une ambassade au Gabon, mais le royaume hésite pour des raisons notamment économiques et financières (le pays vivant en mode austérité présentement). Le visite récente du diplomate britannique des installations de Setanta au Gabon est certainement une première étape de cette redynamisation.

Mais il apparaît selon nos informations que Setanta avait de la difficulté à faire avancer son dossier au Gabon, n'ayant pas reçu beaucoup d'aides du ministère en charge du pétrole (notamment à l’époque où Paul Biyoghé Mba était premier ministre). Ce qui a valu quelques frustrations de la part des Britanniques qui salivent sur le champ de Roussette dont Setanta est propriétaire des deux tiers depuis 2007 selon Africa Energy Intelligence. Pour Setanta, c’est un projet d’exploitation pétrolière évalué à plus de 4 milliards d'euros de revenus, selon nos informations. Setanta fait miroiter beaucoup d’argent en recettes fiscales et autres partages de revenus au Gabon, et propose dans son projet de remettre 25% de ces revenus à l’état.

Jusqu'ici, rien de bien particulièrement nouveau dans le pillage du pétrole gabonais. Là où les choses deviennent intéressantes à suivre est que, selon toujours nos informations (obtenues avant la sortie de l'article de Africa Energy Intelligence), le partenaire proposé par le Gabon pour le champ de Roussette est « une société inconnue avec un palmarès douteux, à 51% du capital angolais (nous apprenons de l'article de Africa Intelligence qu'il s'agit de l’angolaise PetroPlus) et 49% du capital appartiendrait à une compagnie enregistrée dans une fiducie opaque dans les îles Vierges britanniques » (paradis fiscal). Nos informations indiquent par ailleurs très bien que « les entreprises britanniques ne pouvaient pas facilement faire des affaires avec des entités de cette nature compte tenu de leurs lois anti-corruption. Et cela, d’ajouter, « est en conflit avec l'engagement déclaré du gouvernement gabonais de lutter contre les déficits de gouvernance». Qui au Gabon a alors demandé à Setanta Energy de faire affaire avec ce partenaire louche et gênant que décriaient pourtant les Britanniques depuis le début de la proposition gabonaise? Surtout que lorsque Ali Bongo a demandé à Setanta si elle avait besoin d'un partenaire, la compagnie a répondu haut et fort: « NON, absolument pas », comme le confirment nos informations.

Pour ne pas trop déranger l'insistance du Gabon pour un partenaire, Setanta a indiqué préférer la Compagnie pétrolière du Gabon ou Gabon Oil Compagny (GOC) créée par Ali Bongo après son arrivée contestée au pouvoir; ce que prévoit d'ailleurs le projet de nouveau code des hydrocarbures. GOC aurait même acceptée une offre dite généreuse de 25% du projet. Alors, pourquoi insister sur un partenaire douteux? Le choix de Setanta était d'aller de l'avant avec un partenaire plus crédible, si c’était la préférence du gouvernement gabonais que Setanta ait absolument un partenaire dans un projet qu'elle peut très bien exécuter toute seule.  Décidément, on dirait que quelqu’un au sommet de l’état veut profiter personnellement de la manne pétrolière?

Maintenant que le champ de Roussette est partagé entre Setanta et PetroPlus d’Angola, le peuple gabonais est dans son droit de demander aux autorités judiciaires britanniques de faire enquête sur cette transaction de Setanta Energy qui pue le souffre et pourrait contrevenir aux lois anti-corruption du Royaume-Uni.  Setanta Energy a-t-elle capitulé devant la pression gabonaise pour un partenaire pourtant « au palmarès douteux », donc contre les lois britanniques anti-corruption?

Bien plus, le gouvernement gabonais n’a jamais dévoilé les rapports d’audits pétroliers qui semblent avoir mis en évidence des « niveaux extraordinaires d'abus et de fraude par certaines compagnies pétrolières internationales », comme le précisent nos informations. Ali Bongo protège qui en gardant secrets ces audits?

Le peuple gabonais doit savoir. Le peuple gabonais en a marre des hypocrites et illégitimes politiciens comme Ali Bongo qui racontent qu’ils veulent la Justice sociale, alors qu’ils travaillent sans relâche dans l’ombre avec leurs amis étrangers pour piller les ressources qui appartiennent à tous les Gabonais.

Libreville, Gabon. September 5, 2012. On the night of Wednesday 4th to Thursday, September 5th, at around 3am, a squad of six people attacked the television studios of TV+ (opposition media) located in Libreville seafront, near Air France office.
After molesting the guardian of the building, causing him a serious head injury and a dislocated right shoulder, and with a cutter and chisel he was able to cut the gate protecting the entrance door of the TV studios, but the armored door was able to resist to the assault and prevented the intrusion of the criminals into the offices of TV+.
The commando than fled because the guardian sitting inside the studios of TV+ was able to immediately alert the other guards from the surrounding buildings, and also the inhabitants of the building were TV+ is located. They immediately called the police, which arrived on the scene to take note of the damage.
After he escaped by night, the same commando, a little later around 4:30 am, was screened at the site where TV+ transmitters are located in Nkembo’s neighbourhood in Libreville, behind St. Michael's Church. He went there to strike again by vandalizing this site of this opposition TV station; as it was already been burned by a commando in the night of August 15th to the 16th around 1 am. The twenty guards protecting the Nkembo’s site have to intervene vigorously and face this commando who fled.
Franck Nguema, Chairman and Director General of TV+ Gabon, reminds the national and international communities that his TV station, in less than a month, has been victim of very violent attacks of commandos causing damage estimated around tens of millions of CFA francs.
While Ali Bongo Ondimba then continues to proclaim in his speeches, here and elsewhere, that Gabon is a state of law, and that he is for freedom of expression, opinion and of the press, we should not forget that such acts remind us of the darkest hours of the death squads of dictatorial regimes that have passed through the history of Africa and the world. "Who can believe that Ali Bongo Ondimba is a democrat when his regime is monopolizing the state media for his exclusive propaganda, and it is using anti-democratic methods by physically attacking and gagging private media in order to prevent the opposition from expressing themselves freely? Indeed, the promise of Ali Bongo Ondimba only bind those who believe in them, because in reality we are facing a dictatorship emerging in Gabon since 2009, and it is unfortunate for the development and social cohesion of Gabon, "says Franck Nguema.

Rappel Partie 1: Ce jour, mercredi 02 septembre 2009 à 11 h 00, le Général OPERHA Paul, Chef d’Etat-major de l’armée de Terre en présence de ses deux Adjoints, Colonel OLAME NDONG et Colonel NKOUEREY Dominique, vient de donner les ordres suivants, qu’il a reçu d’Ali Bongo.

Le Bulletin de renseignement quotidien (BRQ) du jeudi 3 septembre 2009

Objet : Scénario du coup d’Etat électoral Jeudi 9h45

Etaient convoqués en urgence au palais présidentiel :

• Abogué Ella ; • JF Ndongou ; • Koumba Souvi.

Par le Président de la République pour une ultime et dernière et consultation où attendaient déjà : • Ali Bongo ; • Mbourantsouo ; • Boukoubi ; • Ngari ; • Andjembé ; • Nzouba

 Les généraux :

• Kouna Grégoire (Garde Républicaine) • Sougou Abel (commandant en chef de la gendarmerie nationale); • Mangolo, Général ; • Bibaye, Général de brigade ; • Opérha, Chef d’Etat-major de l’armée de Terre; • et Ella Ekogha (chef d’état major général des Forces armées)

10h00 : Aboghé Ella, Koumba Souvi et Ndongou arrivent à l’Etat major de l’Armée de terre sous escorte des généraux Opérha, Ella Ekogha et Mangolo à bord de Jeep Mercedes militaires .

Concertation et ordre préparatoire à l’assaut final

NB --> Aboghé Ella, Koumba Souvi et Ndongou sont séquestrés, intimidés et menacés de mort puis promus à des fonctions diverses, cela se passe en présence du Président de la République qui ne réagit pas.

En présence de tout le personnel travaillant à l’Etat major de l’armée de terre, l’ordre est donné de ne pas sortir hors de la barrière avant la fin de la proclamation des résultats.

NB --> Le Directeur des Télécoms est convoqué, l’annuaire téléphonique de l’armée lui est remis pour brouiller tous les appels entre 10h00 et 12h00.

L’ordre suivant est donné au Lieutenant Major Ndjami Richard commandant une petite unité spéciale de circonstance des bérets rouge composée uniquement des tékés pour qu’ils n’hésitent pas de tirer ni se faire trahir.

Disperser l’attroupement du rond point de la Démocratie par les grenades lacrymogènes, charger les opposants, en cas de résistance tirer à balles réelles.

10h30 : Après le compte rendu du Lieutenant Major Ndjami, sortie et départ de la délégation vers la CENAP, suivi et couvert par un hélicoptère.

NB --> C’est le Général Ella Ekogha qui a donné l’ordre verbal de tirer à balles réelles : « N’hésitez pas de tirer, tirez, tirez, tirez » ?

NB --> A titre de rappel, le scénario initialement annoncé dans le message de mercredi 2 septembre 2009 est resté le même en dehors des horaires qui ont été décalés. Au lieu de minuit (24h) voir midi (12h) du lendemain.

NB --> C’est toujours le Lieutenant Ndjami qui est l’auteur, à la tête de ses quatre (4) éléments, de tirer sur la station de Go Africa sur recommandation du Général Ella Ekogha qui lui-même a reçu l’ordre d’Ali Bongo Ondimba.

Conclusion : Des tirs à balles réelles ne sont pas les faits conjugués de toutes les forces, mais d’une petite unité de tékés illettrés infiltrés dans le dispositif afin de semer la confusion

Les comploteurs sont donc : Rose Rogombé, Ali Bongo, Mbourantsouo, Boukoubi, Ngari, Andjembé et Nzouba.

Voici le récit du coup d’état électoral du 02 au 03 septembre 2009 et comment Aboghé Ella, Koumba Souvi et Ndongou ont été séquestrés.

Nous vous livrons in extenso le bulletin d’information quotidien du jeudi 3 septembre relatant la préparation du coup d’Etat électoral orchestré par Ali Bongo Ondimba.

Ce jour, mercredi 02 septembre 2009 à 11 h 00, le Général OPERHA Paul, Chef d’Etat-major de l’armée de Terre en présence de ses deux Adjoints, Colonel OLAME NDONG et Colonel NKOUEREY Dominique, vient de donner les ordres suivants, qu’il a reçu d’Ali Bongo :

• Avant 15 h 00, tous les militaires, du soldat à l’officier supérieur, chacun doit rejoindre son unité en urgence;

Mission : Prendre chacun une arme et des munitions – faire mouvement vers la CENAP – encercler les bâtiments.

NB. : Si ABO n’est pas élu – donner l’assaut, s’emparer des procès-verbaux, semer la confusion totale et rejoindre les casernes.

A minuit, escorter le Ministre NDONGOU à la RTG1 pour annoncer les résultats, à l’issue, il doit déclarer un couvre-feu – couper toutes les communications intérieures et extérieures – garder les opposants en résidence surveillée. ''NB: Si ABO n’est pas élu – donner l’assaut, s’emparer des procès-verbaux, semer la confusion totale et rejoindre les casernes''...

How to get Gabon out of the crisis?

June 30 to July 3, 2012



After the National Conference of 1990, Gabon had experienced the beginning of democratization by the introduction of multiparty politics, and it was essential to continue this process in order to build a state of law.

But one objective observation of the political context of Gabon since 2009 is that the minimum conditions for an electoral choice by free citizens have never been achieved after the usurpation of the legitimacy of the people by Ali Bongo ONDIMBA, who proclaimed himself president of Gabon in 2009.

In spite of this crisis, and beyond partisan considerations, the Civil Society, through a Memorandum, Gabonese Diaspora in France by a proposal for joint consultation in Paris, and representatives of opposition political parties, with support of these projects, got together to find the root causes of this situation and find answers suitable to achieve peace and stability in the country.

Thus, was held from June 30 to July 3, 2012 in Paris, a meeting of plural opposition political groups, civil society and the Gabon’s diaspora in France, for a democratic dialogue open to any citizen of Gabon sure to find a solution to the crisis that Gabon has been experiencing due to the seizing of the rights of the people of Gabon by Ali BONGO-ONDIMBA.


I. CONTEXT AND JUSTIFICATION

The early presidential election of 30 August 2009 gave the country the opportunity for a fresh start. September 03, 2009, Jean-François Ndongou, Minister of Defense and the Interior, of then the Interim Government through the transition following the death of President Omar Bongo on June 8th 2009, helped by the defense forces, halted abruptly the electoral process and organized the installation in power of Ali Bongo Ondimba.

That Sept. 3, 2009, while candidates in the presidential election expected that the Plenary Assembly of the Autonomous and Permanent National Electoral Commission (CENAP), only body competent decision at election time, to complete its work and report to the Minister of the Interior the results of the election, the latter (Jean-François Ndongou), escorted by a detachment of paratroopers headed by Major General Jean Claude ELLA EKOGHA, Chief of Staff of the Gabonese armed forces, interrupted the work of the CENAP to announce results that have not been validated. The unusual presence of armed soldiers in the working room of the Plenary of the National Independent and Permanent Electoral Commission (CENAP) had neither more nor less objective than the fulfillment of an electoral coup that Constitutional Court will validate later proclaiming Ali Bongo Ondimba winner of the election.

The electoral coup that led to the swearing of Ali Bongo Ondimba October 16, 2009 was made possible by the complicity of men and women who were in charge of many Institutions of the Republic. The President of the Republic and its Acting Government, the President of the Constitutional Court, the Chairman of the National Communications Council and Chairman of the Independent and Permanent National Electoral Commission which should be the arbiters of the transition, by their actions and decisions, they have made possible a process of organizing a succession of monarchical type in Gabon.

From September 3, 2009, the other candidates in the presidential election showed the forfeiture to the Constitutional Court and denounced the election coup d’état. Motions to quash the election of Ali Bongo Ondimba have shown, beyond doubt, the extent of the fraud orchestrated for his own benefit.

The contradictory election recounts requested by the applicants, according to the letter of the proceedings, have never been accepted by the Constitutional Court.

President of France (Nicolas Sarkozy), the President of the African Union Commission (Jean Ping) and the Secretary General of the Organization of the United Nations (Ban Ki Moon) were formally seized of this situation.

On February 24, 2010, the Memorandum submitted to Nicolas SARKOZY on behalf of the Gabonese opposition stated: "... the people of Gabon is clearly in favor of change in his vote of 30 August 2009, an illegitimate power, enjoying a form outside interference, settled in defiance of the reality of the polls with the complicity of internal institutions of the Republic and the instrumentalization of the defense forces and security. "

On July 1st, 2010, the two main opposition groups, the CPPA and the ACR, addressed to the Secretary General of the UN, a memorandum which stated also that "Since the death of President Omar Bongo on June 8, 2009 and the election coup d’état of September 3, 2009 which imposed a monarchical-type succession in Gabon, the political transition is compromised by the clearly expressed will of the Parti Démocratique Gabonais (PDG) to confiscate power in defiance of the rules of the rule of law and the will of the people of Gabon. "

In February 2011, civil society has produced a Memorandum on the socio-political crisis and a study on the analysis of the functioning of republican institutions. These two (2) contributions have led to the formulation of thirteen (13) proposals on the restoration of democracy and the rule of law in Gabon.

Ali Bongo knows he was not elected and is aware of the challenge to its forfeiture. His awareness of this uncomfortable situation, to say the least, explains the systematic use of the army, its permanent presence in the streets of Libreville, repression and widespread violations of freedoms that can be observed for about three years in Gabon and that the constitutional amendment of December 2010, non-consensual and contested by the Opposition, was a major act of democratic regression.

Since the electoral coup of September 3, 2009, the opposition parties including the National Union (Union Nationale) and Civil Society have never recognized the illegitimate power of Ali Bongo Ondimba. They have said publicly, arguing methodically about the justification for the rejection. They seized it to international institutions, and several friendly countries including France. It is thus an ongoing process.

Indeed, the political crisis in Gabon is deep. We have rarely seen such a retreat of democracy and the rule of law. This is particularly evident in the dissolution of the National Union, the first political force of the opposition, the organization of political trials against the opposition leaders and civil society, the prohibition or punishment of any public demonstration or peaceful march of the opposition or simply citizens to protest against injustice, abuse by the arbitrary arrests of independent journalists, by the assimilation of the social demands of students inclinations to political destabilization and by muscular raids on university campuses by the army or the police followed by arrests of students, by censorship of the press and broadcast neutral media providing objective information, by prohibition or limitation of movements (in or out of the country) of members of the opposition or persons judged as such. This list of antidemocratic behaviors of Ali Bongo’s regime is of course, not exhaustive.

Changing the constitution to strengthen the powers and prerogatives of Mr. Ali Bongo Ondimba, including not limiting presidential terms; the issuance of decrees and orders drastically reducing the scope of participation of Gabonese in politics and the rights of opposition; the systematic distortion of the role of the National Commission responsible for administering the electoral process and biases of the Constitutional Court are some of the elements contributing to the regression of democracy in Gabon. Today, almost all power is concentrated in the hands of one man. The Government of the Republic is deprived of his prerogatives in favor of newly created agencies and depending only on the Presidency of the Republic. The “monarchy-sation” of Gabon is on completely!

The parliamentary elections of December 17, 2011 were boycotted by some opposition and strongly denounced by civil society. Indeed, after the beginning of 2011 the government was asked by the opposition to increase transparency of the electoral process through the introduction of biometrics in voter registration in order to avoid unnecessary post-election wrangling, and the Government responded to the opposition with the decision that electoral transparency would not be conceivable before 2013, during local elections. The ruling party PDG has gained 114 of 120 parliamentary seats. This scandal reinstated the single party system in the National Assembly where there is only one parliamentary group, compare to five earlier. The people who followed the boycott slogan of the opposition and civil society gathered in the movement “Enough of That” refrained from going to the polls at 92%.

On the economic and social fronts

The economic and social situation of Gabon today is characterized by an impoverishment increasingly growing for much of the population, despite the importance of its financial resources, and by low attractiveness of the investment, and a poor quality of growth. Developments noted in the last three years are quite disturbing in many ways.

According to the annual report of the National Commission for Fight against Illicit Enrichment (CNLCEI) of 2010, based on data from Transparency International (TI) (2010), Gabon was ranked 110th (out of 178 countries evaluated) according to the barometer of corruption, with a corruption index valued at 2.9 out of 10. This ranking, which ranks the country among those who record a level of endemic corruption, is up four spots on the 2009 and is worse than that of 2007 which placed already Gabon to the 84th place with an index evaluated at 3, 3 of 10 according to the same NGO.

With regard to fiscal consolidation, announced with fanfare by Ali Bongo, it was supposed to focus on reducing the lifestyle of the State, Audit of Public service sector and management of public debt.

While purporting to reduce the lifestyle of the State, Ali Bongo has performed to date, hundreds of foreign travel. At a rate of 3 billion CFA francs per trip, on average. For the years 2009 and 2010 this represented approximately 300 billion CFA francs paid by the taxpayer of Gabon.

While purporting to reduce the lifestyle of the State, Ali Bongo has offered himself a mansion in Paris for a staggering 65 billion CFA francs paid by the Treasury, but not included in the state budget.

While purporting to reduce the lifestyle of the State, Ali Bongo has offered himself a fleet of 29 luxury cars for 10 billion CFA francs paid with money from Gabon, public accounts, but unbudgeted.

While purporting to reduce the lifestyle of the State, the Government has bought two successive fleets of luxury cars, in 10 months. A fleet of 4x4 Mitsubishi brand in November 2009 and a fleet of Mercedes sedans in August 2010 paid with taxpayer money.

While purporting to reduce the lifestyle of the state by eliminating some functions and reducing some expenses, Ali Bongo, at the same time has created other functions and increased some functional salaries. Finally, the ruling power took advantage of the fiftieth anniversary of Independence of our country to engage 63.364 billion CFA francs of lavish spending while only 35 billion were budgeted.

Regarding the audit of the Public service sector, he announced the following objectives:
• optimizing the functioning of public administration and its effectiveness;
• improving productivity and performance of public officials;
• achieving budget savings and efficiency of public administration.

Three years later, you always wonder where are the results of the census of public officials presented by its promoters as new idea and has been completed many, many months ago? Where are the results of audits of payroll and jobs completed since the end of March 2010?

In fact, instead of "finding pockets of economy" and make public administration more efficient, there has been, during the year 2010:

• An increase in the wage bill of 55.2 billion CFA francs, from 370 billion CFA francs in 2009 to more than 425 billion CFA francs in the draft supplementary budget of 2010. Or a 15% increase in one year!
• A total demobilization of the public administration because of amateurism, change in daily work schedule, witch hunt tactics, intimidation and a reckoning by the ruling power.

About the public debt, we realize that in June 2009, it was 1,320 billions (1.3 trillion) CFA francs, of which 223.7 billions CFA francs of domestic debt and 1,096 billion (1.096 trillion) CFA francs of external debt. In one year, the State of Gabon increased its debt by more than 1000 billions (1 trillion) CFA francs, an increase of 75% of the country's debt in one year, through over 100 contracts and agreements to indebtedness of all kinds.

The Gabonese government budget is still only to be performed and the various public administration departments lack the means to fulfill their missions. In the meantime, the regime in power uses and abuses of extra-budgetary procedures, to drain public resources that are reduced mainly to finance personal expenses.  It is this situation, which accounts for most of the financial pressure that the government can no longer hide and the International Monetary Fund has confirmed that in its report of July 2010.

Contrary to the assertions of the authority, those budget tensions lead the state to defer payment due to gabonese small and medium businesses (SMEs), which forces them to make massive lay offs or simply to disappear.

Among other measures to revive the economy, the government has introduced such measures as: the abrupt and illegal ban on export of logs; the introduction of totally improvised daily working days schedule shuffle (so-called “continuing daily work schedule”); setting up the capital-investment budget at 897 billion of CFA francs; the remediation of the business environment to increase the attractiveness of Gabon.
Concerning logs, at the Council of Ministers of November 05, 2009, the authority announced "the ban, in 2010, of logs exports for the benefit of the local processing of our forest tree species to create more wealth necessary to curb unemployment and especially for young people and women, and to export finished and semi-finished high value-added logging products. "

One year after the country's timber production was strongly reduced and local processing has not increased.  In the meantime, thousands of jobs were destroyed. Many forestry companies have already experienced bankruptcy and others are preparing to do so. As we said from the outset, this has precipitated an economic and social cost very heavy for Gabon.

The untimely introduction of the so-called continuing daily work schedule (journée continue) is also a real disaster. In the public service sector, the continuing daily work schedule (from 7 am to 2 pm, with no midday lunch pause as before) was simply transformed into half-day work, with consequences that we know in terms of productivity, quality of service, public health, and family cohesion.

The last three years as been years of creation of public institutions, agencies attached to the Presidency and whose management are associated with or implicated foreigners. This is the case of the National Agency of National Parks, the Agency for Information Technology, Gabonese Agency for studies and observation of space and the National Agency of Great work. These agencies are, in reality, a parallel government established by the Office of the President who completely is beyond the control of the Parliament and which in practice leads to conflicts of attribution.

In addition, the proposed special economic zone (SEZ) of Nkok is the property of Olam Group. The partnership agreement signed with the multinational Olam, property of an investment fund based in Singapore, for the development of this project, is now a state secret. This special economic zone appears increasingly as a zone of lawlessness in the economy, taxation and workers.

In this environment, many investors wonder every day a little more about the real risk now imposed on their investments in Gabon.

As for the housing sector, the government had pompously announced the construction of 5,000 homes per year, three years later the Gabonese are still waiting. In the meantime, extensive destruction of homes has been made without any policy for restitution that is set up to help families affected.

A radical break is needed. It is appropriate to base the civil activity, especially in public life, even on values that can guarantee the establishment of a better governance system in Gabon.

The rehabilitation of civic morality base on core values of Integrity, Liberty, Justice, Security and Employment is an imperative need to restore the rule of general interest over special interests, and to create an enabling environment for investors. Law and Justice must prevail for all, without exception, always to protect the weak and to secure businesses. They should compel those who break the rules and promote those who respect them. These basic principles that underlie behavior and economic growth of winning Nations must be restored in Gabon.


II. WE MUST GET OUT OF THE CRISIS

The Gabonese Constitution states:

Article 117: The republican form of government, and the pluralistic nature of democracy are intangible and cannot be subject to any revision.

The electoral coup that is the basis of the ongoing political crisis in Gabon is a flagrant violation of the principles defined here. The person who, as of to date, is exercising the function of the President of the Gabonese Republic, without having received the majority vote of the Gabonese people, cannot therefore enjoy any legitimacy.

Also, the last constitutional revision of January 12, 2011, which was intended only to strengthen the powers of Ali Bongo is unconstitutional because it violates very clearly both the spirit and letter of Article 117 above quoted.

The republican form of government has been weathered and democracy is strongly in regression.  From then on, it is the responsibility of every citizen of Gabon to engage in struggle for the restoration of republican and democratic values in a nationalist or patriotic way. Gabon is not and will not be a monarchy.

The Constitution specifies, in particular in its Article 3, that "no section of the people, no group, no individual may usurp the exercise of national sovereignty." In seeking to consolidate power acquired unlawfully, Ali Bongo violates the Constitution every day.

Accordingly, without delay and by any means necessary, to process of “monarchy-sation” underway in Gabon should be terminated. To this end and following the peaceful character of the Gabonese people, priority must be given to an initiative involving all Gabonese through a Sovereign National Conference.

This is our exit paperwork for Gabon to get out of the deep crisis that has been going on since the early presidential election that took place on August 30, 2009.

For a successful conclusion of this roadmap, we would ask for France, a country that is very familiar with this situation, to help, along with the United Nations, for the implementation of this gait pledge of peace and stability, as well as of an harmonious, balanced and fair development process in our country.
